vantage-red\">\u4ef2<\/span>\u88c1\u6761\u6b3e\u662f\u4ef2\u88c1\u7684\u57fa\u77f3\uff0c\u6709\u6548\u7684\u4ef2\u88c1\u6761\u6b3e\u662f\u4ef2\u88c1\u7a0b\u5e8f\u5f97\u4ee5\u987a\u5229\u5f00\u5c55\u7684\u4fdd\u969c\u3002\u7136\u800c\uff0c\u5b9e\u52a1\u4e2d\uff0c\u7455\u75b5\u4ef2\u88c1\u6761\u6b3e\u5e76\u4e0d\u7f55\u89c1\u3002\u4e2d\u56fd\u56fd\u9645\u7ecf\u6d4e\u8d38\u6613\u4ef2\u88c1\u59d4\u5458\u4f1a\u9999\u6e2f\u4ef2\u88c1\u4e2d\u5fc3\uff08\u4e0b\u79f0\u201c\u8d38\u4ef2\u9999\u6e2f\u201d\uff09\u5728\u65e5\u5e38\u6848\u4ef6\u7ba1\u7406\u548c\u63a5\u53d7\u5f53\u4e8b\u4eba\u54a8\u8be2\u7684\u8fc7\u7a0b\u4e2d\u5e38\u89c1\u7684\u4ef2\u88c1\u6761\u6b3e\u7455\u75b5\u5305\u62ec\uff1a\u7ea6\u5b9a\u7684\u4ef2\u88c1\u673a\u6784\/\u4ef2\u88c1\u89c4\u5219\u4e0d\u5b58\u5728\u6216\u4e0d\u660e\u786e\u3001\u4ef2\u88c1\u6761\u6b3e\u7684\u53cc\u8bed\u7248\u672c\u4e92\u76f8\u51b2\u7a81\u6216\u4e0d\u517c\u5bb9\u3001\u7ea6\u5b9a\u7684\u4ef2\u88c1\u5ead\u7ec4\u6210\u7a0b\u5e8f\u96be\u4ee5\u6267\u884c\u7b49\u3002\u73b0\u5b9e\u4e2d\uff0c\u5f53\u4e8b\u4eba\u5f80\u5f80\u5728\u4e89\u8bae\u53d1\u751f\u540e\u624d\u53d1\u73b0\u5408\u540c\u6240\u8f7d\u4ef2\u88c1\u6761\u6b3e\u5b58\u5728\u7455\u75b5\uff0c\u4e14\u5bf9\u662f\u5426\u80fd\u591f\u57fa\u4e8e\u7455\u75b5\u7684\u4ef2\u88c1\u6761\u6b3e\u63d0\u8d77\u4ef2\u88c1\u7a0b\u5e8f\u5f80\u5f80\u6beb\u65e0\u5934\u7eea\u3002<\/p>\n<p class=\"DD_DD-Body-Chi\" lang=\"zh-CN\" style=\"text-align: justify;\">\u5b9e\u52a1\u4e2d\uff0c\u4e00\u65b9\u5f53\u4e8b\u4eba\u6839\u636e\u7455\u75b5\u4ef2\u88c1\u6761\u6b3e\u63d0\u8d77\u4ef2\u88c1\u7a0b\u5e8f\uff0c\u800c\u53e6\u4e00\u65b9\u5f53\u4e8b\u4eba\u5c31\u6b64\u63d0\u51fa\u7ba1\u8f96\u6743\u5f02\u8bae\u65f6\uff0c\u9999\u6e2f\u4ef2\u88c1\u5ead\u5c06\u5982\u4f55\u5224\u65ad\u4ef2\u88c1\u6761\u6b3e\u7684\u6548\u529b\uff1f\u7b14\u8005\u5c06\u4ee5\u8d38\u4ef2\u9999\u6e2f\u5ba1\u7ed3\u7684\uff0c\u6d89\u53ca\u7455\u75b5\u4ef2\u88c1\u6761\u6b3e\u7684\u67d0\u6848\u4ef6\u4f5c\u4e3a\u5b9e\u4f8b\u8fdb\u884c\u5206\u6790\u3002<\/p>\n<h2 style=\"text-align: justify; margin-bottom: 5px;\"><span class=\"vantage-red\"><strong>\u4ef2\u88c1\u6761\u6b3e\u548c\u7ba1\u8f96\u6743\u5f02\u8bae<\/strong><\/span><\/h2>\n<p class=\"DD_DD-Body-No-indent-Chi\" lang=\"zh-CN\" style=\"text-align: justify;\">\u6848\u6d89\u5408\u540c\u4ee5\u82f1\u6587\u4e66\u5c31\uff0c\u5176\u4ef2\u88c1\u6761\u6b3e\u7ea6\u5b9a\uff1a\u201cAll disputes \u2026 shall then be submitted for arbitration to HONG KONG International Economic and Trade Arbitration Commission \u2026 The contract is governed by the law of HONG KONG \u2026\u201d\uff08\u201c\u4e89\u8bae\u2026\u2026\u987b\u5411\u9999\u6e2f\u56fd\u9645\u7ecf\u6d4e\u8d38\u6613\u4ef2\u88c1\u59d4\u5458\u4f1a\u63d0\u4ea4\u2026\u2026\u672c\u5408\u540c\u53d7\u9999\u6e2f\u6cd5\u5f8b\u7ba1\u8f96\u201d\uff09\u3002<\/p>\n<p class=\"DD_DD-Body-Chi\" lang=\"zh-CN\" style=\"text-align: justify;\">\u7533\u8bf7\u4eba\u4f9d\u636e\u4e0a\u8ff0\u4ef2\u88c1\u6761\u6b3e\u5411\u8d38\u4ef2\u9999\u6e2f\u63d0\u4ea4\u4ef2\u88c1\u7533\u8bf7\uff0c\u8d38\u4ef2\u9999\u6e2f\u5bf9\u6848\u4ef6\u6750\u6599\u8fdb\u884c\u8868\u9762\u5ba1\u67e5\u540e\uff0c\u8ba4\u4e3a\u7b26\u5408\u53d7\u7406\u6761\u4ef6\u5e76\u6839\u636e\u300a\u4e2d\u56fd\u56fd\u9645\u7ecf\u6d4e\u8d38\u6613\u4ef2\u88c1\u59d4\u5458\u4f1a\u4ef2\u88c1\u89c4\u5219\u300b\uff08\u4e0b\u79f0\u300a\u8d38\u4ef2\u89c4\u5219\u300b\uff09\u7684\u89c4\u5b9a\u53d7\u7406\u4e86\u6848\u4ef6\u5e76\u5206\u522b\u5411\u7533\u8bf7\u4eba\u548c\u88ab\u7533\u8bf7\u4eba\u53d1\u51fa\u4e86\u300a\u4ef2\u88c1\u901a\u77e5\u300b\u3002<\/p>\n<p class=\"DD_DD-Body-Chi\" lang=\"zh-CN\" style=\"text-align: justify;\">\u5176\u540e\uff0c\u88ab\u7533\u8bf7\u4eba\u63d0\u51fa\u7ba1\u8f96\u6743\u5f02\u8bae\uff0c\u8d28\u7591\u4ef2\u88c1\u6761\u6b3e\u4e2d\u7ea6\u5b9a\u7684\u4ef2\u88c1\u673a\u6784\u5e76\u4e0d\u5b58\u5728\uff0c\u5e76\u8ba4\u4e3a\u4ef2\u88c1\u5ead\u5bf9\u672c\u6848\u6ca1\u6709\u7ba1\u8f96\u6743\u3002\u7533\u8bf7\u4eba\u5219\u53cd\u9a73\u79f0\uff0c\u4ef2\u88c1\u6761\u6b3e\u6240\u6307\u4ef2\u88c1\u673a\u6784\u7684\u540d\u79f0\u4e0e\u8d38\u4ef2\u9999\u6e2f\u9ad8\u5ea6\u76f8\u4f3c\uff0c\u6e05\u695a\u5730\u8868\u660e\u53cc\u65b9\u5f53\u4e8b\u4eba\u6709\u610f\u5c06\u4e89\u8bae\u63d0\u4ea4\u81f3\u8d38\u4ef2\u9999\u6e2f\u8fdb\u884c\u4ef2\u88c1\u3002<\/p>\n<h2 style=\"text-align: justify; margin-bottom: 5px;\"><span class=\"vantage-red\"><strong>\u4ef2\u88c1\u5ead\u7684\u7ba1\u8f96\u6743\u51b3\u5b9a<\/strong><\/span><\/h2>\n<p class=\"DD_DD-Body-No-indent-Chi\" lang=\"zh-CN\" style=\"text-align: justify;\">\u6839\u636e\u300a\u8d38\u4ef2\u89c4\u5219\u300b\u7b2c\u516d\u7ae0\u201c\u9999\u6e2f\u4ef2\u88c1\u7684\u7279\u522b\u89c4\u5b9a\u201d\u7b2c\u4e03\u5341\u4e94\u6761\u7684\u89c4\u5b9a\uff0c\u4ef2\u88c1\u5ead\u6709\u6743\u5bf9\u7ba1\u8f96\u6743\u5f02\u8bae\u4f5c\u51fa\u51b3\u5b9a\u3002\u7ecf\u5f00\u5ead\u5ba1\u7406\uff0c\u4ef2\u88c1\u5ead\u5bf9\u672c\u6848\u7ba1\u8f96\u6743\u5f02\u8bae\u5355\u72ec\u4f5c\u51fa\u51b3\u5b9a\uff1a\u9a73\u56de\u88ab\u7533\u8bf7\u4eba\u7684\u7ba1\u8f96\u6743\u5f02\u8bae\uff0c\u5e76\u786e\u5b9a\u8d38\u4ef2\u9999\u6e2f\u5bf9\u672c\u6848\u5177\u6709\u7ba1\u8f96\u6743\u3002<\/p>\n<p class=\"DD_DD-Body-Chi\" lang=\"zh-CN\" style=\"text-align: justify;\">\u4ef2\u88c1\u5ead\u8ba4\u4e3a\uff0c\u672c\u6848\u7ba1\u8f96\u6743\u5f02\u8bae\u7684\u4e89\u8bae\u7126\u70b9\u6d89\u53ca\u5bf9\u4ef2\u88c1\u6761\u6b3e\u7684\u89e3\u91ca\u3002\u901a\u8fc7\u63f4\u5f15\u9999\u6e2f\u7ec8\u5ba1\u6cd5\u9662<em>Jumbo King v Faithful Properties (1999)<\/em>\u4ee5\u53ca<em>Fully Profit (Asia) v The Secretary for Justice (2013)<\/em>\u7b49\u5224\u4f8b\uff0c\u4ef2\u88c1\u5ead\u8ba4\u4e3a\u5408\u540c\u6761\u6b3e\u7684\u89e3\u91ca\u5fc5\u987b\u57fa\u4e8e\u5ba2\u89c2\u4e8b\u5b9e\u8fdb\u884c\uff0c\u5305\u62ec\u53c2\u8003\u5408\u540c\u7b7e\u7f72\u7684\u80cc\u666f\u3001\u6709\u5173\u5408\u540c\u6761\u6b3e\u7684\u4e0a\u4e0b\u6587\u53ca\u76f8\u5173\u7684\u4e8b\u5b9e\u60c5\u51b5\u3002<\/p>\n<p class=\"DD_DD-Body-Chi\" lang=\"zh-CN\" style=\"text-align: justify;\">\u4ef2\u88c1\u5ead\u8fdb\u4e00\u6b65\u63f4\u5f15<em>Lucky-Goldstar International (HK) v Ng Moo Kee Engineering (1993)<\/em> \u4ee5\u53ca<em>HKL Group v Riqz International (2013)<\/em>\u4e24\u4e2a\u5224\u4f8b\uff0c\u8ba4\u4e3a\u82e5\u4ef2\u88c1\u6761\u6b3e\u8868\u660e\u5408\u540c\u5404\u65b9\u6709\u610f\u5c06\u4e89\u8bae\u63d0\u4ea4\u4ef2\u88c1\uff0c\u867d\u7136\u4ef2\u88c1\u6761\u6b3e\u6307\u5411\u4e0d\u5b58\u5728\u7684\u4ef2\u88c1\u673a\u6784\uff0c\u4f46\uff08\u4ef2\u88c1\u5ead\uff09\u53ef\u4ee5\u8fdb\u4e00\u6b65\u901a\u8fc7\u4ef2\u88c1\u6761\u6b3e\u6240\u6307\u5411\u7684\u57ce\u5e02\u6216\u4e89\u8bae\u6d89\u53ca\u7684\u4e1a\u52a1\u7c7b\u522b\uff0c\u63a8\u65ad\u5408\u540c\u5404\u65b9\u6240\u7ea6\u5b9a\u7684\u4ef2\u88c1\u673a\u6784\u3002<\/p>\n<p class=\"DD_DD-Body-Chi\" lang=\"zh-CN\" style=\"text-align: justify;\">\u4ef2\u88c1\u5ead\u8fdb\u4e00\u6b65\u8be0\u91ca\uff0c\u5728\u56fd\u9645\u5546\u4e8b\u4ef2\u88c1\u7684\u80cc\u666f\u4e0b\uff0c\u5728\u9999\u6e2f\u53ea\u6709\u8d38\u4ef2\u9999\u6e2f\u7684\u82f1\u6587\u540d\u79f0\u542b\u6709\u201cEconomic and Trade\u201d\u8be5\u7b49\u5bf9\u4ef2\u88c1\u6848\u4ef6\u7c7b\u522b\u8fdb\u884c\u5b9a\u6027\u7684\u5b57\u773c\uff1b\u518d\u8005\uff0c\u5728\u9999\u6e2f\u53ea\u6709\u8d38\u4ef2\u9999\u6e2f\u7684\u82f1\u6587\u540d\u79f0\u5305\u542b\u201cHONG KONG International Economic and Trade Arbitration Commission\u201d\u7684\u6bcf\u4e00\u4e2a\u5355\u8bcd\u3002<\/p>\n<p class=\"DD_DD-Body-Chi\" lang=\"zh-CN\" style=\"text-align: justify;\">\u57fa\u4e8e\u4e0a\u8ff0\u7406\u7531\u4ee5\u53ca\u672c\u6848\u53cc\u65b9\u5f53\u4e8b\u4eba\u95f4\u7684\u4ea4\u6613\u80cc\u666f\uff0c\u4ef2\u88c1\u5ead\u51b3\u5b9a\uff1a\u201c\u8be5\u4ef2\u88c1\u6761\u6b3e\u4e2d\u7684\u2018Hong Kong International Economic and Trade Arbitration Commission\u2019\u5e94\u88ab\u8be0\u91ca\u4e3a\u2018China International Economic and Trade Arbitration Commission Hong Kong Arbitration Centre\u2019\uff08\u4e2d\u56fd\u56fd\u9645\u7ecf\u6d4e\u8d38\u6613\u4ef2\u88c1\u59d4\u5458\u4f1a\u9999\u6e2f\u4ef2\u88c1\u4e2d\u5fc3\uff09\u3002\u201d\u56e0\u6b64\uff0c\u4ef2\u88c1\u5ead\u5bf9\u6848\u4ef6\u5177\u6709\u7ba1\u8f96\u6743\u3002<\/p>\n<h2 style=\"text-align: justify; margin-bottom: 5px;\"><span class=\"vantage-red\"><strong> \u53c2\u8003\u610f\u4e49<\/strong><\/span><\/h2>\n<p class=\"DD_DD-Body-No-indent-Chi\" lang=\"zh-CN\" style=\"text-align: justify;\">\u4e0a\u8ff0\u6848\u4f8b\u5bf9\u4e8e\u8ba2\u7acb\u4e86\u7455\u75b5\u4ef2\u88c1\u6761\u6b3e\u7684\u5f53\u4e8b\u4eba\u5177\u6709\u91cd\u8981\u7684\u53c2\u8003\u610f\u4e49\u3002<\/p>\n<p class=\"DD_DD-Body-Chi\" lang=\"zh-CN\" style=\"text-align: justify;\">\u9996\u5148\uff0c\u8d38\u4ef2\u9999\u6e2f\u5728\u7acb\u6848\u9636\u6bb5\u4e00\u822c\u53ea\u5bf9\u4ef2\u88c1\u6761\u6b3e\u8fdb\u884c\u8868\u9762\u5ba1\u67e5\uff0c\u5f53\u4e8b\u4eba\u53ef\u4ee5\u76f4\u63a5\u5411\u8d38\u4ef2\u9999\u6e2f\u63d0\u4ea4\u4ef2\u88c1\u7533\u8bf7\u3002\u5982\u8d38\u4ef2\u9999\u6e2f\u7ecf\u8868\u9762\u5ba1\u67e5\u8ba4\u4e3a\u7b26\u5408\u53d7\u7406\u6761\u4ef6\u5e76\u53d7\u7406\u6848\u4ef6\u540e\uff0c\u5f53\u4e8b\u4eba\u5bf9\u4ef2\u88c1\u6761\u6b3e\u6216\u4ef2\u88c1\u6848\u4ef6\u7684\u7ba1\u8f96\u6743\u6709\u5f02\u8bae\uff0c\u53ef\u4ee5\u6839\u636e\u300a\u8d38\u4ef2\u89c4\u5219\u300b\u7b2c\u4e03\u5341\u4e94\u6761\u7b2c\uff08\u4e00\uff09\u6b3e\u7684\u89c4\u5b9a\uff0c\u5728\u7b2c\u4e00\u6b21\u5b9e\u4f53\u7b54\u8fa9\u524d\u63d0\u51fa\u3002<\/p>\n<p class=\"DD_DD-Body-Chi\" lang=\"zh-CN\" style=\"text-align: justify;\">\u518d\u8005\uff0c\u6709\u522b\u4e8e\u5185\u5730\u73b0\u884c\u300a\u4ef2\u88c1\u6cd5\u300b\u7684\u89c4\u5b9a\uff0c\u6839\u636e\u9999\u6e2f\u300a\u4ef2\u88c1\u6761\u4f8b\u300b\uff08\u7b2c609\u7ae0\uff09\u7b2c34\u6761\u4ee5\u53ca\u300a\u8d38\u4ef2\u89c4\u5219\u300b\u7b2c\u4e03\u5341\u4e94\u6761\u7b2c\uff08\u4e8c\uff09\u6b3e\u7684\u89c4\u5b9a\uff0c\u8d38\u4ef2\u9999\u6e2f\u7684\u4ef2\u88c1\u5ead\u62e5\u6709\u81ea\u88c1\u7ba1\u8f96\u6743\uff08competence-competence\uff09\uff0c\u4ef2\u88c1\u5ead\u53ef\u4ee5\u76f4\u63a5\u5c31\u81ea\u8eab\u662f\u5426\u62e5\u6709\u5bf9\u6848\u6d89\u4e89\u8bae\u7684\u7ba1\u8f96\u6743\u4f5c\u51fa\u51b3\u5b9a\uff0c\u800c\u65e0\u9700\u4ef2\u88c1\u673a\u6784\u7684\u6388\u6743\uff0c\u53ef\u4ee5\u6709\u6548\u7f29\u77ed\u7a0b\u5e8f\u65f6\u957f\uff0c\u63d0\u9ad8\u7a0b\u5e8f\u6548\u7387\u3002<\/p>\n<h2 style=\"text-align: justify; margin-bottom: 5px;\"><span class=\"vantage-red\"><strong> \u5584\u7528\u793a\u8303\u4ef2\u88c1\u6761\u6b3e<\/strong><\/span><\/h2>\n<p class=\"DD_DD-Body-No-indent-Chi\" lang=\"zh-CN\" style=\"text-align: justify;\">\u5b9e\u52a1\u4e2d\uff0c\u8d38\u4ef2\u9999\u6e2f\u5ba1\u7ed3\u7684\uff0c\u6d89\u53ca\u7455\u75b5\u4ef2\u88c1\u6761\u6b3e\u7684\u6848\u4ef6\u4e2d\uff0c\u6682\u672a\u6709\u4ef2\u88c1\u5ead\u4f5c\u51fa\u8d38\u4ef2\u9999\u6e2f\u5bf9\u6848\u4ef6\u6ca1\u6709\u7ba1\u8f96\u6743\u7684\u51b3\u5b9a\u3002<\/p>\n<p class=\"DD_DD-Body-Chi\" lang=\"zh-CN\" style=\"text-align: justify;\">\u5c3d\u7ba1\u5982\u6b64\uff0c\u4e3a\u907f\u514d\u56e0\u7ba1\u8f96\u6743\u5f02\u8bae\u6240\u53ef\u80fd\u5bfc\u81f4\u7684\u989d\u5916\u4ef2\u88c1\u8d39\u7528\uff0c\u5f53\u4e8b\u4eba\u53ef\u4ee5\u8003\u8651\u5c06\u793a\u8303\u4ef2\u88c1\u6761\u6b3e\u7eb3\u5165\u5408\u540c\u3002\u4f8b\u5982\uff0c\u8d38\u4ef2\u9999\u6e2f\u7684\u793a\u8303\u4ef2\u88c1\u6761\u6b3e\u5982\u4e0b\uff1a<\/p>\n<p class=\"DD_DD-Body-Chi\" lang=\"zh-CN\" style=\"text-align: justify;\">\u201c\u51e1\u56e0\u672c\u5408\u540c\u5f15\u8d77\u7684\u6216\u4e0e\u672c\u5408\u540c\u6709\u5173\u7684\u4efb\u4f55\u4e89\u8bae\uff0c\u5747\u5e94\u63d0\u4ea4\u4e2d\u56fd\u56fd\u9645\u7ecf\u6d4e\u8d38\u6613\u4ef2\u88c1\u59d4\u5458\u4f1a\u9999\u6e2f\u4ef2\u88c1\u4e2d\u5fc3\uff0c\u6309\u7167\u7533\u8bf7\u4ef2\u88c1\u65f6\u8be5\u4f1a\u73b0\u884c\u6709\u6548\u7684\u4ef2\u88c1\u89c4\u5219\u8fdb\u884c\u4ef2\u88c1\u3002\u4ef2\u88c1\u88c1\u51b3\u662f\u7ec8\u5c40\u7684\uff0c\u5bf9\u53cc\u65b9\u5747\u6709\u7ea6\u675f\u529b\u3002\u201d<\/p>\n<p justify;\">\u5f53\u4e8b\u4eba\u8fd8\u53ef\u4ee5\u8003\u8651\u5bf9\u4ef2\u88c1\u6761\u6b3e\u7684\u7ba1\u8f96\u6cd5\u5f8b\u3001\u4ef2\u88c1\u5730\u3001\u4ef2\u88c1\u8bed\u8a00\u3001\u5f00\u5ead\u5730\u7b49\u4e8b\u9879\u8fdb\u884c\u7ea6\u5b9a\u3002<\/p>\n<hr
