Peter Ludwig’s article The perils of patent outsourcing in last month’s issue inappropriately cited the recent notice from the USPTO as “expressing concern” over the practice of offshore outsourcing of US patent work.
The recently issued USPTO’s notice in the Federal Register (Vol. 73, No. 142/Wednesday, 23 July 2008/Notices), titled “Scope of Foreign Filing Licenses”, expresses no such concern.
The notice is directed toward the export of subject matter pursuant to a licence from the USPTO. The notice reminds applicants and registered patent practitioners that the export of subject matter pursuant to a licence from the USPTO is limited to the filing of foreign patent applications.
