The Goodyear Tire & Rubber Company has succeeded in an action for infringement and passing off against the manufacturers, distributors and retailers of a company using the mark “Good” in their tyres and tubes businesses. Goodyear Tire & Rubber, in its case against Harish Gugnani & Ors, sought to restrain the defendants from using “Good” as the predominant feature of several of their marks (Good Wear, Good Care, Good Air, etc.) and other Goodyear formative marks and variations on their tyres and tubes.
