Introduction

David Lin has a comprehensive educational background in engineering and law. Among the areas of his expertise are patents, copyrights, trade secrets, unfair competition, technology media telecommunications. As lead attorney, he defended Sinovel in actions brought by American Superconductor for copyright infringement and trade-secret misappropriation, for which the claimed damage (RMB3 billion) ranks as the highest so far in intellectual property litigations involving China and the US.

Besides, he provides IP services for well-known Internet and high-tech enterprises, such as Samsung, ZTE, Xiaomi, Meituan, Youku, Kingsoft, among others. He has also provided comprehensive IP services for the Ministry of Transport, Tsinghua University, Qilu Pharmaceutical, Nike, Evergrande Real Estate, and Ping An Groups and other national ministries and large commercial institutions.

Awards

In 2008, Lin represented the copyright infringement dispute involving the “Struggle” TV series and it became a typical case of the “red flag standard” in the infringement case of information network dissemination rights. In 2009, he represented Tsinghua University in well-known trademarks and unfair competition cases, which the Beijing High People’s Court marked as typical IP matters. In 2015, he represented Xiaomi in winning a case against Qihoo regarding jurisdiction objection, which Beijing courts selected as the Annual Top Ten IP Creative Cases. In 2018, his case, Xiaomi versus Li concerning the reputation right dispute was selected as one of the top 10 network typical cases of the Haidian Court. CLECSS named Lin as an outstanding young lawyer in 2017. A year later, he was selected as the leading Chinese lawyer – Antitrust and Competition Law.
